In accordance with the provisions of Article 6-III of Law No. 2004-575 of 21 June 2004 for confidence in the digital economy ("LCEN"), the users of the website https://klarity.coach and of the application https://app.klarity.coach (hereinafter "Klarity") are hereby informed of the present legal notice.

Klarity is an online software (SaaS) that assists the practice of coaching, intended for independent Professionals. It enables client and session management, note-taking, the generation of session reports and briefings, as well as an AI-assisted session memory (automatic summaries, briefings, search and chat over the longitudinal memory).

2. Hosting

In accordance with Article 6-III of the LCEN, the identity of the hosts is set out below. Klarity's architecture distinguishes the hosting of the marketing website / frontend from that of the application backend and the data.

The server infrastructure (compute, file storage, secrets) relies on the Amazon Web Services (AWS) services operated in the eu-west-3 (Paris, France) region. The relational database and the authentication service are also hosted within the European Union, in the eu-west-3 region (Paris, France).

3. Intellectual property

The "Klarity" (Klarity) trademark, as well as the associated logos, visual identities, names and distinctive signs, are the exclusive property of Boostage or are used under authorization. Any reproduction, representation, use or modification, in whole or in part, without prior written authorization, is prohibited and constitutes infringement within the meaning of Articles L.335-2 et seq. and L.713-2 et seq. of the French Intellectual Property Code.

All the elements making up the website and the application — structure, texts, interfaces, illustrations, graphic elements, databases as well as the source code — are protected by intellectual property law and remain the exclusive property of Boostage, with the exception of third-party components used under their respective licenses.

The content created or imported by the user as part of their use of Klarity (client records, notes, summaries, imported documents, session histories) remains the property of the user or of their respective holders. Boostage holds over such content only the rights strictly necessary for the provision of the service, under the conditions set out in the General Terms and Conditions of Use and Sale and the Privacy Policy.

4. Personal data

Boostage attaches particular importance to the protection of personal data, in compliance with Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act (loi Informatique et Libertés) No. 78-17 of 6 January 1978 as amended.

Given the nature of Klarity, the publisher processes two main categories of data:

  • the data of the Professional users (account, billing, preferences);
  • the data relating to the Professionals' clients (records, notes, session transcripts and summaries, longitudinal memory), processed by the publisher in its capacity as processor on behalf of the Professional acting as data controller, such data potentially being of a sensitive nature.

The procedures for collecting, processing, retaining and securing the data, as well as for exercising your rights (access, rectification, erasure, restriction, objection, portability), are detailed in the Privacy Policy.

5. Cookies

The website and the application may place cookies and trackers, notably for functional, security, audience measurement and, where applicable, personalization purposes. Cookies that are not strictly necessary are only placed after obtaining your consent, in accordance with Article 82 of the French Data Protection Act (loi Informatique et Libertés) and the CNIL's recommendations.

6. Complaints and amicable settlement

Any complaint relating to the Service may be sent in writing to the publisher (support@klarity.coach), who endeavors to provide a response within a reasonable time with a view to an amicable resolution.

Klarity is aimed exclusively at professionals acting for the purposes of their business. The consumer mediation scheme provided for in Articles L.612-1 et seq. of the French Consumer Code, reserved for consumers, does not apply to this relationship. The terms for resolving disputes are set out in the Terms and Conditions (Article 24).

7. Applicable law and competent jurisdiction

The present legal notice is governed by French law.

In the event of a dispute relating to its interpretation or performance, and failing an amicable resolution, the French courts shall have sole jurisdiction, subject to the mandatory rules of jurisdiction applicable.
